Terms of Service

1. Scope and Parties

These Terms of Service ("Terms") govern your use of the ClassifiedAsset platform ("Service"), operated by SimplyMobile Sp. z o.o., ul. Juliana Fałata 10, 05-820 Piastów, Poland, KRS 0000741967 ("we", "us").

The Service is a business-to-business (B2B) platform intended for organisations and their authorised employees. By creating an account you confirm that you are at least 18 years old and authorised to bind your organisation to these Terms.

2. Description of Service

ClassifiedAsset is a SaaS platform that helps manufacturers classify machinery and manage compliance activities related to Machinery Regulation (EU) 2023/1230, including classification, risk assessment, technical documentation, declarations, and workflow approvals.

3. Subscription Plans and Pricing

The Service is offered in the following tiers:

• Free — limited features at no cost (see Section 4)
• Basic, Pro, Enterprise — paid plans with expanded limits

Paid plans are billed either monthly or yearly. Yearly billing includes a 10% discount compared to the equivalent monthly rate. Current pricing is displayed on our website and may be updated with 30 days' prior notice.

4. Free Tier

The Free tier is provided at no charge subject to the limits published on our pricing page (currently: 10 machines, 1 user). We reserve the right to modify Free tier limits (e.g., storage quotas, feature availability) with at least 1 month's prior notice communicated via the platform or email.

5. Payment and Refunds

• Payments are processed through our payment provider (Mollie). You agree to keep valid payment details on file for the duration of your paid subscription.
• If a payment fails, we provide a 14-day grace period to resolve the issue. If payment is not received within this period, the account may be suspended.
• Refunds are calculated on a pro-rata basis for the unused portion of the current billing period.

6. Your Data and Ownership

You own your data. All content you enter into the Service — including machine data, risk assessments, documentation, and uploaded attachments — remains your intellectual property. We do not claim any ownership rights over your data.

You grant us a limited licence to host, store, and process your data solely for the purpose of providing the Service to you.

7. Cancellation and Data Export

You may cancel your subscription at any time. Upon cancellation:

• You retain access until the end of the current billing period.
• You have 30 days after the end of your subscription to export or download your data.
• After the 30-day export period, your data will be permanently deleted, except for audit logs retained under legal obligations (see our Privacy Policy).

8. Acceptable Use

You agree not to:

• Upload or transmit viruses, malware, or any malicious code
• Attempt to gain unauthorised access to the Service, other accounts, or our infrastructure
• Use the Service in any way that violates applicable laws or regulations
• Interfere with or disrupt the integrity or performance of the Service

Violation of these rules may result in immediate suspension or termination of your account.

9. No Compliance Guarantee

ClassifiedAsset is a tool to assist with compliance activities. It does not constitute legal advice and does not guarantee regulatory compliance. The manufacturer remains solely responsible for ensuring that their machinery meets all requirements of Machinery Regulation (EU) 2023/1230 and any other applicable legislation.

We recommend consulting qualified legal and technical advisors for compliance decisions.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" without warranties of any kind, express or implied.
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
• Our total aggregate liability for any claims related to the Service is limited to the fees you have paid to us in the 6 months preceding the event giving rise to the claim.

11. Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance when possible. We are not liable for downtime caused by circumstances beyond our reasonable control.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated with at least 30 days' notice via the platform or email. Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Poland. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Warsaw, Poland.
